Carlisle development control committee met on 20/6/14

Members resolved to give authority to the Director (Economic Development) to issue approval for the proposal subject to the satisfactory completion of a Section 106 Agreement regarding the conservation management area(s) for wintering geese and breeding waders. Following this decision, the Secretary of State, under Article 25 of the Town and Country Planning (Development Management Procedure) Order 2010, has directed the Council not to grant permission without specific authorisation.

The first application for planning permission, Ref: 11/0118 was ultimately refused by the Secretary of State for Communities and Local Government (see below) but a second application has now been submitted.

Second planning application, November 2013

This second planning application was submitted to Carlisle City Council in November 2013 and the application documents can be seen by clicking this link: [1]. Representations can be sent to the Planning Manager at Carlisle by email or post or via the website during a limited period, currently stated as 21 days starting 11 November 2013.
Please note that objections and any other comments submitted in respect of the first application will not be carried forward to this new application; new letters, emails, or comments on the website will need to be submitted, quoting the reference 13/0865 and, if objecting, the word ‘object’ or ‘objection’ should be prominently included in the first sentence, to ensure the submission is correctly categorised.

First planning application February 2011

The first application for planning permission, Ref: 11/0118  was submitted to Carlisle City Council in February 2011 - see the application documents and representations received by the Council.  The Planning Officer’s report recommended refusal of planning permission.  The Planning Committee agreed and the formal Decision Notice was issued on 19 August 2011.

On 24 February 2012 the applicant lodged an Appeal with the Planning Inspectorate (Reference APP/E0915/A/12/2170838/WF).  A Public Inquiry was held, split into two parts: Part 1, in October 2012 considered all outstanding matters except the MoD objection relating to the Eskdalemuir observatory; Part 2, in December 2012, was combined with the Beck Burn Inquiry so that the Eskdalemuir issues could be considered in the context of both Inquiries. The Appeal was dismissed in May 2013 by Eric Pickles as Secretary of State (following the Inspector’s recommendation to approve the proposals subject to a Condition relating to Eskdalemuir).
